Attorney Phillip Weinberg’s client was facing two serious gross misdemeanor cases and an initial indication we were looking at substantial jail time, one case with three counts (Indecent Exposure, Resisting Arrest and Obstructing Law Enforcement Officer) and one case for Assault 4 DV. Mr. Weinberg was able to show the true, unstable nature of the alleged victim, as well as her lack of truthfulness, and obtained a 2-year continuance, with no jail, after which, with alcohol treatment, the three count case for Indecent Exposure, Resisting Arrest and Obstructing Law Enforcement Officer will be dismissed, and in the other case, Phillip Weinberg got the Assault 4 DV case reduced to Disorderly Conduct and have the DV label (referred to often as the “DV tag”) removed, with only 2 days jail less credit for time served, resulting in no additional jail time.
