Have you been arrested for DUI in Bellevue? If yes, then it’s most likely you have been arrested by Bellevue Police and will be prosecuted in the Bellevue District Court.

DUI Process in Bellevue, WA

  • Arrested for DUI.
  • Breathalyzed for alcohol levels.
  • If you refuse you will be taken to the Overlake Hospital where blood will be drawn.
  • Evidence forwarded by the Bellevue Police to the City of Bellevue Prosecutor for their filing decision.
  • Your blood sent to be processed by the Washington State Toxicology Lab (and this can now take up to 9 months!).
  • Transported to King County Jail or SCORE Jail in Des Moines (an especially awful jail, like a mini prison).

First Hearing with Bellevue DUI Attorney Phil Weinberg

The first hearing is a pretrial hearing and will ordinarily be roughly 3-6 weeks after the arraignment. Moreover, depending upon how congested the court calendars are at the time.  In fact, many things need to be discussed and done to prepare for that critical hearing.

I know how the system works and what the Bellevue City Prosecutors will likely seek from the court against you. Also, which private evaluators and treatment professionals to refer you to so we can prepare a. defense. In addition, there are almost always other things I will ask you to proactively do in order to optimize your defense. For example, attending a 90-minute DUI Victim Impact panel and obtaining an alcohol/drug evaluation (and in some cases, a mental-health assessment, too, if you are willing to do so and if it will help your defense, as it very often does). Other things you may be asked by me to do ASAP could include performing some voluntary community service hours, when applicable.

Bellevue DUI Attorney Phil Weinberg will fight to get your case dismissed

As an experienced DUI Attorney, I always start out optimistically and realistically thinking your case can be dismissed on good pretrial motion practice or won at trial. I will not recommend that you proceed to trial unless you want and agree to go to trial; this is never my decision – it is yours alone. But I help you reach your decision based upon the strengths and weaknesses of the case and the charge(s) filed against you. Also, there may be several pretrial hearings while I am negotiating or preparing for trial, arguing pretrial motions to suppress evidence or dismiss the case, and gathering all available evidence to support our defense plan.

Don’t be a ‘sitting duck’.  Go to Bellevue District Court with an experienced, seasoned Bellevue DUI defense attorney on your side. I go all-out for my clients in the Bellevue District Court.

I have defended many hundreds if not thousands of DUIs over the past three decades. I am frankly well known by many of judges and prosecutors in Bellevue District Court.

Repeat DUI

A repeat drunk driving offense could fall into several categories:

  • You got into an accident in which someone was hurt.
  • Major property damage occurred.
  • You had a child passenger (under age 16) in your vehicle.
  • Your first appearance in court will include bail and other burdensome conditions. For example, the judge could impose bail, Ignition Interlock Device, or SCRAM or TAD device (an ankle bracelet that measures for alcohol consumption), or Electronic Home Monitoring.
  • Having an experienced private Bellevue DUI attorney at that hearing representing you is a must.

I am here to help you get an optimal and dignified result. Dismissal must always be the first goal, but if it cannot be had in your matter. I am extremely successful in avoiding jail time for my clients.

About Bellevue Court & Bellevue Arrests for Drunk Driving / DUI

There is one court in Bellevue, a District Court, part of the King County District Court System. The King County District Court (KCDC), East Division – Bellevue Facility (Courthouse) handles misdemeanors, gross misdemeanors, infractions, anti-harassment and protection orders (if no children are involved) and minor civil actions. It enforces the Revised Code of Washington (RCW) and the Bellevue Municipal Code, Title 10.

Have you been arrested for DUI in Bellevue?

If you’re arrested by a Bellevue Police officer for Drunk Driving / DUI, your case will be heard at Bellevue District Court, though if you are in custody it is possible your first appearance for arraignment or to see if the prosecutor will file its complaint within 72 hours may be in Seattle at the KCDC jail Courtroom #1. This court is located at 1309 114th Ave SE #100, Bellevue, WA 98004.  Bellevue District Court no longer handles state cases resulting from arrests by the Washington State Patrol (WSP) or King County cases that occur when a King County Sheriff arrests you; these are handled in Seattle usually if the arrest was in the Bellevue vicinity, at the KCDC West Division, Seattle Courthouse. Arrestees booked on a Friday night, over the weekend or the day before or day of a legal holiday must wait in jail until the court reopens to appear before a judge to seek their release from custody.

How it works – Your Arraignment

The first hearing is the arraignment. The plea you enter at the arraignment should always be “Not Guilty”; regardless of the facts and circumstances of your case. The court will also set conditions of release at this hearing. Prosecutors often ask the judge to impose strict conditions such as bail or an Ignition Interlock Device. An experienced Bellevue DUI defense attorney can usually effectively resist these conditions, especially on first-time offenses.

Next – Pretrial Hearings, Negotiation

Next, there are Pretrial Conferences, also called Pretrial Hearings (PTR). Most cases have several PTR’s before they are resolved or set for trial. They generally occur 4-5 weeks apart. After a few of them, the court will often pressure the defense to conclude the case with a plea deal or go to trial. If a good offer is presented by the prosecutor, the case can be disposed of by a plea deal (plea bargain) at a PTR. During this process, your defense attorney will be investigating your case and obtaining police reports, medical records, interviews from witnesses, victims, experts and law enforcement as well as any other evidence related to your case.

Pretrial Motions

There are numerous pretrial motions that can have a significant impact on your defense – or even result in the dismissal of your case. A few common ones include motions to challenge probable cause (PC) for the stop or arrest, whether statements made by the police, witnesses or defendant are admissible, motions to compel or limit discovery and Sixth Amendment right to counsel deprivation motions. Pretrial motions require extensive legal briefing and strategic planning to be successful.

Readiness Hearing & Trial

Less than 15% of DUI cases filed proceed to trial – trial is frankly the last resort due to the inherent risk and cost. You may choose to go to trial in the event the prosecution has not offered an agreeable plea deal, or if a conviction would be unacceptable or especially damaging to your career and/or personal life.

Washington’s DUI Laws are strengthening

Remember, there are new bills being enforced when it comes to DUI in Washington. For example, the House Bill 1614 – DUI Laws, has further strengthened the laws around DUI. Moreover, don’t get caught trying to defend yourself or appearing with an inexperienced novice DUI attorney.

Phil Weinberg has over 25 years of experience and has a wealth of tools, an excellent private investigator available at all times, and numerous effective defense strategies to fight your case. Call Phil at: (425) 455-4784.
