Criminal Charges in Everett Washington
People arrested for a Criminal Charge in Everett’s city limits by the Everett Police are prosecuted (assuming they get charged) in Everett Municipal Court, which is a new one-story courthouse a block away from the Snohomish County Superior Court. It is at the corner of Pacific and Wetmore at 3028 Wetmore Avenue, Everett, WA 98201. That court’s website is online at: https://www.everettwa.gov/316/Municipal-Court.
If you are stopped by a Snohomish County Sheriff or a State Trooper (“WSP”) you will be taken directly to the Snohomish County Jail and your DUI charge/case will be filed in the Everett Division of the Snohomish County District Court System (aka “Everett District Court”). Arrestees are booked into the Everett City jail or the Snohomish County Jail. If the charge the police are investigating (think you have committed and have arrested you for, etc.) seems to law enforcement to involve alcohol and/or drugs, and if you refuse to provide breath samples or if drugs are suspected, you will be taken to providence Hospital, while still in custody, and your blood will be drawn by a hospital phlebotomist and given to the police as evidence to be processed by the Washington State Toxicology Lab, a process which can sometimes and usually does take many months (some of our cases have blood draws that don’t come back for nearly one year!) because they are severely backlogged due to major budget cuts and other unknown reasons. This poses serious challenges because all sorts of evidence, witnesses, video, audio, street markings, officers’ field notes, public defenders’ notes, clothing, weapons, etc. can and often does disappear in the interim.
Criminal Charges in Everett are investigated by the Everett Police Department, the Washington State Patrol or the Snohomish County Sheriff’s Office. No matter what charge you are facing, whether felony or misdemeanor (including gross and simple misdemeanors), I can help. Many things need to be discussed and done to prepare for that hearing. I know when they have not provided all of the discovery and evidence, too, and have private investigators to assist us when needed as well. Also, there are things I will ask you to proactively do, if you are willing, in order to optimize your defense, including obtaining an alcohol/drug evaluation (and in some cases, a mental-health assessment, too), a DV assessment if applicable, as well as performing some voluntary community service hours, if I think it will help.
Of course, if I think your case can be dismissed on pretrial motion practice or won at trial I will not recommend that you do those things, but you must want and agree to go to trial; this is never my decision – it is yours alone, but I will help you reach your decision based upon the strengths and weaknesses of the case and the charge(s) filed against you.
There may be several pretrial hearings while I am negotiating with the assigned prosecutor, or preparing for trial, arguing pretrial motions to suppress evidence or dismiss the case, or both, and gathering all available evidence to support our defense plan.
